Personal Information Protection and Electronic Documents Act
AVP Recovery Inc. is committed to respecting the personal privacy of individuals we deal with and has prepared this privacy policy regarding the collection, use and disclosure of personal information to ensure AVP Recovery Inc.’s continual compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), a federally enacted act which protects personal information that is collected, used or disclosed.
1. Accountability
AVP Recovery Inc. is responsible for the personal information under its control and has designated a Privacy Officer to ensure AVP Recovery Inc.’s compliance with PIPEDA.
2. Identifying Purpose
AVP Recovery Inc. will openly identify and inform individuals of the purposes for requesting and collecting of personal information. AVP Recovery Inc. collects personal information for the recovery of debts assigned by clients or purchased by AVP Recovery Inc.
3. Consent
Except where permitted or required by law, AVP Recovery Inc. will obtain the consent of the Consumer, or our client’s transfer of consent, that permits our activities for the collection, use, or disclosure of personal information.
4. Limiting Collection
AVP Recovery Inc. will only collect personal information by fair and lawful means for our defined purpose.
5. Limiting Use, Disclosure & Retention
AVP Recovery Inc. will retain personal information for as long as it is necessary to fulfill the purpose for which it was collected and as required be applicable laws. AVP Recovery Inc. will securely dispose of any information that is no longer needed for the completion of its business activities.
6. Accuracy
AVP Recovery Inc. will take all reasonable steps to ensure that the personal information under its control is accurately maintained, complete and up to date as is necessary to fulfill the purposes for which this information is to be used.
7. Safeguards
AVP Recovery Inc. will take reasonable measures to protect personal information by means of appropriate security safeguards as required by the sensitive nature of the personal information maintained.
8. Openness
The policies of AVP Recovery Inc. relating to the management of personal information are available to all individuals who wish to review and discuss the practical application and measures taken to protect all sensitive information.
9. Individual Access
AVP Recovery Inc. will inform an individual of the existence, use and disclosure of their personal information once requested. AVP Recovery Inc. may refuse access where: revealing the requested personal information will reveal information about a third party and cannot be severed from the requested information; the disclosure could threaten the life or security of another individual; the information was generated in a formal dispute resolution process; the information is subject to solicitor-client or litigation privilege; there is a preexisting contractual restriction, or for other reasons not mentioned. If a request is refused, AVP Recovery Inc. will notify the individual in writing, documenting the reason(s) for refusal.
10. Challenging Compliance
An individual shall be able to address a challenge concerning compliance with the above privacy principles to AVP Recovery Inc.’s Privacy Officer. The Privacy Officer oversees privacy governance including policy, dispute resolution, education, questions and concerns and can be reached at:
